West Virginia licenses individual fire protection workers: state law requires anyone performing fire protection work to hold a State Fire Marshal licence, and the two sprinkler classes are Journeyman Sprinkler Fitter and Fire Protection Layout Technician.
| Requirements | West Virginia Code section 29-3D-3 provides that on and after January 1, 2009, a person performing or offering to perform fire protection work in this state shall have a license issued by the State Fire Marshal, and licensed individuals must carry documentation of the licence while working. The statute exempts homeowners working on a single-family dwelling they own or lease, employees of manufacturing plants and industrial sites working for the facility operator, public utility employees, contractors installing or repairing water distribution, drainage lines or treatment systems, HVAC technicians, and persons working at active mining or coal processing operations. The State Fire Marshal's licensure sheet sets the qualifications: Journeyman Sprinkler Fitter, described as installing, adjusting, repairing and dismantling fire protection systems, requires 2,000 hours of work experience installing, adjusting, repairing and dismantling fire protection systems, with proof of that experience submitted with the application, and the sheet notes that this licence does not qualify holders to certify sprinkler systems. Fire Protection Layout Technician requires NICET Level III with a copy of the certificate of completion. The engineered and pre-engineered suppression classes require manufacturer certifications, and the Portable Fire Extinguisher Technician must be certified in accordance with NFPA 10. Licence fees are $100 for one year or $175 for three years for a Journeyman Sprinkler Fitter or Fire Protection Layout Technician, plus a non-refundable $50 application fee with each application. Separately, the contracting business is licensed by the West Virginia Contractor Licensing Board within the Division of Labor, whose classifications include Sprinklers and Fire Protection Contractor, defined as a contractor engaged in the installation, repair or maintenance of fire suppression systems including water sprinkler and chemical systems and work incidental to the installation or repair; that classification requires an 80 question, three hour trade examination in addition to the Contractor Licensing Act examination. |
| Reciprocity | Yes, and by two routes. Under 103 CSR 3 ('Supervision of Fire Protection Work', State Fire Marshal, filed 4/15/2024, effective 5/1/2024), § 103-3-14 provides that the State Fire Marshal in his or her discretion may grant a licence of the same classification without examination to a fire protection technician licensed by another state upon payment of the licence fee and application fee and submission of a completed application, and may issue a fire protection technician certificate to any person who holds a valid certification, licence or registration to conduct fire protection work issued by another state, a United States possession, or the District of Columbia that has standards substantially equivalent to or exceeding those of West Virginia, as determined by the State Fire Marshal. No states are named. Separately, § 103-3-7.8 is a mandatory universal-recognition route under W. Va. Code ch. 29 art. 33: the Fire Marshal shall issue a licence to an applicant who holds a valid similar out-of-state licence with substantially similar scope, education and examination requirements, has held it at least one year, met that state's educational and examination requirements, is in good standing there, has established West Virginia residency, has no disqualifying criminal record, has never had the licence revoked or surrendered for negligence or misconduct, has no pending complaint or investigation, and pays all applicable fees; § 103-3-7.9 provides a parallel work-experience route for applicants from non-licensing states requiring at least two years of experience and passage of any required national examination. The rule covers all Fire Protection Worker categories defined in § 103-3-3, which include Journeyman Sprinkler Fitter and Sprinkler-Based Fire Protection Layout Technician (the latter requiring NICET Level III or higher), as well as fire protection damper, portable fire extinguisher and pre-engineered and engineered suppression system technicians. The separate business 'Sprinkler & Fire Protection' classification on the general West Virginia contractor licence is administered by the Contractor Licensing Board, whose reciprocity document could not be retrieved, so no position is recorded for that classification. |
| Renewal | The State Fire Marshal states that licensure expires either annually or every three years based upon the initial licensure date. Renewal notices are mailed roughly 90 days before the expiration date as a courtesy, but failure to receive one does not excuse non-renewal. A licensee who fails to renew must resubmit a new application with supporting documentation and pay the application and licence fees again. |
