New Mexico does license boiler operators: the Construction Industries Division of the Regulation and Licensing Department issues boiler operator certificates of competence in a low pressure and a high pressure classification, coded BO1 and BO2. The licensing requirement bites at publicly owned places of public assembly such as public schools and public hospitals, where state rule bars anyone without a certificate from working in the trade of boiler operator.
| Requirements | 14.9.4.19 NMAC provides that no individual shall engage in the occupation or trade of boiler operator at a publicly owned place of public assembly unless that person holds a certificate of competence issued by the Construction Industries Division for the occupation or trade of boiler operator. A place of public assembly means any place where large numbers of individuals congregate, such as schools and hospitals, and the rule states it shall not be construed as applying to businesses where private industry is in operation; publicly owned means the same but owned by the public, such as public schools and public hospitals. 14.9.4.20 NMAC adds that any boiler that is not an automatic boiler and is located in a publicly owned place of public assembly shall have a full time licensed operator, and that the operator shall not leave the operating floor for more than 10 minutes at any one time without leaving on duty an operator of the same classification. Under 14.9.4.29 NMAC the low pressure classification requires six months of operating experience on the types of plant to be licensed on and passing the low pressure examination, and permits operation of steam boilers and direct fired pressure vessels up to 15 psi and hot water boilers up to 160 psi and 250 degrees F. The high pressure classification requires at least six months of verifiable operating experience on the types of plant to be licensed on and passing the prescribed examination, and permits operation of high pressure boilers of 15 psi and greater. In lieu of experience, alternative methods of training may be approved by the mechanical bureau chief, and a certificate of competency is issued upon successful completion of the appropriate examination. A boiler operator trainee shall not operate any devices except under the direct observation of a boiler operator. Under 14.6.4.8 NMAC no individual under the age of 18 shall be issued a certificate of competence, and 14.6.6.11 NMAC classes BO1 and BO2 as journeyman boiler operator classifications that require six months of experience, may be employed by an institution that has a boiler, and may not perform construction or repair of a boiler. 14.5.5.9 NMAC sets the boiler operator examination fee at $25.00. |
| Reciprocity | A full-text search of 14.9.4 NMAC (Boilers) and 14.9.3 NMAC (Mechanical) returns no reciprocity, reciprocal or endorsement provision for the journeyman boiler operator certificate of competence. The one cross-jurisdiction route is military-connected only: NMSA 1978 § 60-13-14.1 grants a prima facie licence to a qualified military service member, spouse or dependent, or veteran who holds a current, substantially equivalent out-of-state licence or certificate issued under a comparable construction industries licensing act, and because boiler operator certificates are issued under that same Act the provision reaches them, with no examination required where the credential is substantially equivalent. This is not a general public reciprocity route. |
| Renewal | 14.5.5.9 NMAC sets the boiler operator renewal fee at $25.00 per year, and authorizes the division to increase examination fees by a multiplier of up to three for each classification upon commission approval. Under 14.6.4.8 NMAC the Construction Industries Division mails a renewal application at least 30 days before a certificate expires, but timely renewal remains the certificate holder's own responsibility. The continuing education requirement in that same rule, 16 hours of approved course work before renewal, is applied to a listed set of plumbing, mechanical and electrical journeyman classifications that does not include the boiler operator classifications. |
